Sea of Competency Tuition Services Terms and Conditions

1. Enrollment and Payment:

  • Enrollment in tuition programmes is subject to availability and confirmation by Sea of Competency.

  • Full payment for tuition services is required upon enrollment, unless otherwise agreed in writing by Sea of Competency.

  • All payments are non-refundable, except at the sole discretion of Sea of Competency.

2. Scheduling and Attendance:

  • Tuition sessions are scheduled in 1-hour increments.

  • Students are responsible for attending scheduled sessions on time.

  • Missed sessions, without prior notice and agreement with Sea of Competency, may be forfeited.

  • Rescheduling of sessions is subject to tutor availability and at the discretion of Sea of Competency.

3. Programme Content and Delivery:

  • Sea of Competency provides guidance and mentorship on maritime practices but does not guarantee specific exam outcomes.

  • The content and delivery of tuition programmes may be adjusted at the discretion of Sea of Competency to meet individual student needs and learning objectives.

4. Intellectual Property:

  • All course materials, including lesson notes, presentations, and practice questions, are the intellectual property of Sea of Competency and may not be reproduced or distributed without permission.

5. Student Conduct:

  • Students are expected to conduct themselves professionally and respectfully during tuition sessions.

  • Sea of Competency reserves the right to terminate tuition services for any student who engages in disruptive or inappropriate behavior.

6. Limitation of Liability:

  • Sea of Competency and its tutors shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or relating to the tuition services provided, including but not limited to exam results, career decisions, or any other outcomes.  

7. Disclaimer of Warranties:

  • Sea of Competency provides tuition services "as is" and disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.  

8. Governing Law:

  • These terms and conditions are governed by and construed in accordance with the laws of England and Wales.  

9. Entire Agreement:

  • These terms and conditions constitute the entire agreement between the student and Sea of Competency with respect to the tuition services and supersede all prior or contemporaneous communications and proposals, whether oral or written.

10. Severability:

  • If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

11. Waiver:

  • No waiver of any term or condition of these terms and conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.  

12. Changes to Terms and Conditions:

  • Sea of Competency reserves the right to modify these terms and conditions at any time.

  • Any changes will be posted on our website.
